June Info Bulletin and Meeting Items

This is an important meeting (June) as it will address the following subjects:

Ditch weed cleanup  Skagit County Surface Water Management standards are in effect for Nookachamp residents. Although the HOA cannot enforce these standards, the County can. Rather than argue, please keep the ditch free from plant growth and trash, and obstructions to keep our Development beautiful and enhance property values.

RV, Boat, and Trailer parking in Nookachamp resident areas are for a maximum of  72 hours.

Transition:  The transition of our Board to a wholly elected resident Board has begun. According to our Attorney:
The number of days pursuant to the Declaration is 180 after the sale of the last lot. That date is 5-24-21, so the clock runs until December 20th, 2021.

According to the Bylaws, once we hit December 20th (the "Transition" date) we must hold a meeting to elect a Board of 5 members within 30 days.

The meeting will be to elect the "Initial" Board. The even positions, 2 & 4 will be for one year and the odd positions, 1, 3, & 5 for two years.
There may be additional activities and information with regards to transition. Residents can be assured that we have a functioning well-coordinated Board that will continue to attend to the business of the Nookachamp Hill Homeowners Association. Resident input is always welcomed via emai to Blue Lake Property Management.


Yard Waste:  Resident yard waste continues to be found in common areas. These areas continue to be along Detention Pond 1 (along Otter Pond Road), The Blackberry Court sewer access road, and to the south of the Big Rocks trail to Otter Pond. All residents, especially those with backyard property adjacent to these areas and strongly reminded that these are not their personal dump areas. Dumping of yard waste is against the Rules and Regulation, can cause damage to our Maintenance Contractor equipment by hiding rocks and other damage in debris, and increases HOA costs for its removal.

Dog Waste, Leash, and signs: Dog waste left on the streets in the Development continues to grow and remain a problem. It is an embarrassment and health hazard to our Community and, obviously, the prime offenders are not the dogs, but their owners who consciously leave this waste in public view. While there can be waste left by wild animals or coyotes, the majority of cases still involve pet owners and pet walkers. The Board urges pet owners in the strongest terms to pick up after their pet and dispose of same in your personal trash container.

Dogs must be on a leash under owner control at all times. Verbal control is NOT sufficient.

Speed. Following too closely and Texting:  This also continues to be a problem in the development, especially now with school children at home and longer daylight hours. Please just slow down and refrain from texting and following too closely.

Fireworks: Fireworks and other pyrotechnics at Otter Pond are strictly prohibited and signs to that effect will be posted at the three trailheads and paths to the Pond.   Each year there is damage and trash left at the Pond for others to clean. Fireworks are permitted at your personal residence, but NOT AT OTTER POND.   EVER.

The following are proposed changes to the Rules and Regulations

11. Fireworks and Celebrations.
Pyrotechnic celebrations should be enjoyed with consideration for neighborhood safety and appearance and in compliance with Skagit County codes and ordinances. Fireworks are strictly forbidden on the common ground at Otter Pond. Every attempt should be made to keep debris from falling onto neighboring yards, drives, vehicles, and roofs. All debris must be cleared immediately.
Reasonable consideration should be made to observe quiet hours during July 3, July 4 and New Years holidays.
12. Otter Pond and Common Areas Use:
(Per CC&Rs 2.2, 6.1,6.2 6.4) The Association Common Areas, including the Otter Pond, are considered private property. All homeowners shall follow the rules and warning signs placed in and around all of Otter Pond and its Docks. Homeowners will be held responsible for the adherence of all Guests to Otter Pond Rules. Homeowners’ children, under age 18, are allowed only (4) guests per residence and are equally responsible for their guests’ behavior. Homeowners, when present, have no general limitations but should be respectful of owners who live in Nookachamp Hills Development. Special events such as weddings, memorial services or other large gatherings must be approved in advance by Management.
Guests must be accompanied by the homeowner at all times. If the homeowner leaves Otter Pond, guests must leave the area as well. NO EXCEPTIONS.
Otter Pond Rules and regulations are based on NOOKACHAMP HILLS CCR’S. Listed Violations of Otter
Pond rules include:
a. Use of alcohol or use of marijuana by persons under 21 years of age (per Washington State Law), or illegal drugs.
b. Lewd gestures, or language (swearing)
c. Standing, Sitting, Diving, or Jumping from the railing on the upper Otter Pond dock
d. Vandalism to any of Nookachamp Hills signs, structures or property
e. Loud music or screaming
f. Public nudity, urinating in public areas
g. Aggressive behavior toward or attempts to intimidate any Community Member, or Neighborhood Watch member
h. Trespass (Homeowners allowing guests to use common area without Homeowner being present)
i. Failure to place trash in authorized containers, or remove large or excessive trash not suitable for available containers.
j. Failure to pick up pet waste and place it in an appropriate container, or pack it out if no container is available.
k. All off-leash dog activity. Dogs must be kept on and controlled by a leash at all times.
l. Harassing wildlife or destruction of wildlife habitat
m. Discharge of firearms or air guns, including BB guns and airsoft guns

If you note a violation or non-compliance to these Rules and/or the CC&Rs, etc., you should first make a reasonable attempt to contact the offending party(ies) in an effort to resolve the issue in a non-confrontational manner. If you have not been successful in making contact, or are uncomfortable in addressing the issue with the offending party(ies), please send a written complaint to Management, citing the specific violation to governing documents and including photos/documentation of the offense, if possible. There will be no follow-up on complaints reported by telephone.

Report common area vandalism and maintenance needs to the above address or call (360)757-4904 and be prepared to leave a detailed message with your contact information and the exact location of the repair/maintenance required. Safety concerns, crimes, suspicious behavior, etc. must be immediately reported
